Any contractual link resulting from a reservation or provision of service is subject to these general terms and conditions.
The customer hereby acknowledges that he/she has read these general terms and conditions, accepts all the clauses and undertakes to comply with them.
B&B Berdorfer Eck may amend these terms and conditions at any time.
The general terms and conditions applicable will be those in force on the date of the reservation.

ARTICLE 1 – PRICES

The prices shown are in Euros and include VAT applicable on the day of booking. Any change in the applicable rate, or any modification or introduction of new legal taxes by the competent authorities, will be automatically reflected in the prices indicated on the invoice date. Rates are per room for the number of people indicated and according to the period selected. Unless otherwise stated, no services other than room reservations are included in the rates shown. Rates include 3% VAT and a tourist tax of €10.00 per stay. Some services may be subject to a supplement and may be subject to change without notice. B&B Berdorfer Eck accepts no responsibility for this.

ARTICLE 2 – RESERVATIONS AND MEANS OF PAYMENT

Reservations can be made on the http://www.berdorfereck.lu/ website, by telephone, by e-mail or by post. The reservation will only be effective if it is guaranteed by the customer by providing a valid credit card number and after receipt of a detailed reservation confirmation from B&B Berdorfer Eck.

Protection of personal data:
The customer must agree to the processing of his or her personal data by B&B Berdorfer Eck in accordance with Article 8 of these general terms and conditions, which is essential for the execution of the contract and constitutes a condition precedent to the contract in favour of B&B Berdorfer Eck, at the latest upon confirmation of the booking of his or her stay – either by e-mail or otherwise in writing. In the absence

B&B Berdorfer Eck may reject the contractual relationship.

Payment for all services must be made directly to the hotel (with the exception of reservations prepaid at the time of booking). The hotel reserves the right to refuse any booking if the credit card number is incorrect, the validity date expires before the end of the booked stay or the booking is incomplete. Bookings from all sources are payable in Euro only.
B&B Berdorfer Eck accepts all types of credit card in principle and has a secure reservation system (SSL) which protects and encrypts all sensitive data transmitted at the time of booking in order to prevent any disclosure to third parties. When the booking is registered, the credit card will be authorised to be debited. This will be done for information purposes only, and will under no circumstances debit the account.

The customer is solely responsible for their choice of services and their suitability for their needs, and B&B Berdorfer Eck cannot be held liable in this respect.

ARTICLE 3 – FORCE MAJEURE

The contracting parties are exonerated in the event of partial or total non-performance of their contractual obligations in the event of force majeure. Force majeure is defined as any event beyond the control of the contracting parties and of an unforeseeable and insurmountable nature, which prevents either party from performing all or part of its obligations under the contract.

ARTICLE 4 – CHANGES AND CANCELLATIONS

Any modification or cancellation of a reservation must be requested by email to info@berdorfereck.lu or by telephone on + 352 26 78 44 34.

The modification or cancellation must be expressly confirmed by B&B Berdorfer Eck in writing in order to be binding.
In the event of modification or cancellation of a stay, the following conditions apply (except in cases of force majeure):
For any request to change or cancel a stay made less than 8 days before the planned date of arrival, the full amount of the first night will be charged. Any night not used and booked for more than one day will be invoiced at 90%.
The customer’s credit card will be debited for the corresponding amounts.
Any stay that has already begun must be paid for in full, unless B&B Berdorfer Eck gives prior notice within the above-mentioned period.

In the case of bookings made via the website of one of B&B Berdorfer Eck’s partners, cancellations must be made via the same website. The cancellation conditions that will then apply are specific to the partner and may therefore differ from these conditions.

In the event of modification or cancellation of the holiday by B&B Berdorfer Eck, the customer may not claim any compensation of any kind whatsoever over and above the total price of the holiday cancelled by way of lump-sum compensation, in addition to the right to reimbursement of the part of the price of the holiday cancelled that has already been paid out.

ARTICLE 5 – USE AND OCCUPATION OF THE PREMISES

For reasons of safety and hygiene, pets are not allowed in the establishment.

Rooms are available from 4 p.m. and must be vacated by 11 a.m. on the day of departure. A supplement may be charged for late check-out. In the event of arrival after 6 p.m., reception must be notified.
The customer acknowledges having received the premises, together with the furniture and technical installations, in good condition and undertakes to return them in good condition, unless otherwise stipulated. Any damage to the premises must be reported to B&B Berdorfer Eck immediately following receipt of the keys and first access to the premises.
The guest accepts and undertakes to use the room in a reasonable manner, in accordance with its purpose and as a good father of the family. Any behaviour contrary to good morals and public order will result in the customer’s expulsion from the establishment without any compensation and without any refund if payment has already been made. In such cases, the full price of the stay booked remains payable by the customer.

ARTICLE 6 – COMPLAINTS

All complaints must be sent to B&B Berdorfer Eck by registered letter with return receipt, within 15 days of the departure of the holiday that is the subject of the said complaint. After this period, no complaint can be taken into account.

ARTICLE 7 – INFORMATION TECHNOLOGY AND PRIVACY

In application of the amended law of 30 May 2005 on the protection of privacy in the electronic communications sector, customers are informed that their reservation is subject to computerised personal data processing. Users have the right to access and rectify the data entered, which may be exercised by contacting the registered office: 53, Rue d’Echternach L- 6550 Berdorf, Luxembourg. Please note that this information will not be passed on to third parties.
B&B Berdorfer Eck offers wifi internet access in certain rooms. The guest user undertakes to ensure that the IT resources made available to him/her are not

are not used in any way for illegal purposes, in particular by reproducing, representing, making available or communicating works or objects protected by copyright or neighbouring rights, such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the copyright holders.

ARTICLE 8 – PROTECTION OF PERSONAL DATA

Within the framework of the management of reservations and the follow-up of customers of B&B Berdorfer Eck, personal data must be collected and processed, directly or via an independent reservation engine, by B&B Berdorfer Eck, in particular: surname(s) and first name(s) of customers, address, e-mail address, landline, fax and/or mobile telephone number, bank reference, date and place of birth, family situation, nationality, nature of the reservation (professional or personal), name and address of the company, etc. The data listed above is necessary for the following processing: reservation manager, receipt of documentation from B&B Berdorfer Eck, receipt of follow-up via e-mail for the purpose of studying the reservation, receipt of documentation from B&B Berdorfer Eck, receipt of follow-up via e-mail for the purpose of studying the reservation.

This information is neither sold nor passed on to third parties and is strictly reserved for the internal uses described above.
The General Regulation on the Protection of Personal Data guarantees the customer the right to be informed of the above data at any time, as well as the right to modify, delete or limit it in time.

The customer hereby expressly agrees to the processing of his/her personal data by B&B Berdorfer Eck, which he/she undertakes to confirm to B&B Berdorfer Eck at the time of booking.

ARTICLE 9 – LIABILITY

B&B Berdorfer Eck declines all responsibility in the event of theft, loss, damage or any other type of damage to the customer’s belongings during their stay. The customer shall be held responsible for any damage, deterioration or acts of vandalism that may occur as a result of occupying the premises and/or as a result of the participants and/or staff for whom the customer is responsible, both to movable property, technical installations, decorative objects and real estate belonging or not belonging to B&B Berdorfer Eck (without prejudice to art. 3 hereof).
In such a case, B&B Berdorfer Eck reserves the right to expel the guest from the establishment without any compensation and without any reimbursement of the current stay, and to reimburse any damage caused.

ARTICLE 10 – APPLICABLE LAW

These General Terms and Conditions are governed by Luxembourg law. This applies to both substantive and formal rules. Any disputes will fall within the exclusive jurisdiction of the courts of Luxembourg City.
